Legislative Council Question 15: Mable Chan's written reply on the development and regulation of autonomous driving technology
立法會十五題:自動駕駛技術的發展及監管
Secretary for Transport and Logistics Mable Chan replied in writing to Legislative Council Question 15, stating that autonomous vehicles continue to be governed by existing legislation such as the Road Traffic Ordinance (Cap. 374), with liability depending on the cause of the accident and the burden of proof borne by the operator, vehicle owner or vehicle supplier. Vehicles under the Guangdong-Hong Kong Go South initiative that illegally activate ADAS may be fined, have their driving licences revoked or even face imprisonment, while third-party liability for personal injury or death is generally afforded statutory protection.
The written reply sets out item by item the attribution of legal liability for autonomous vehicles, penalties for vehicles under the Guangdong-Hong Kong Go South initiative that illegally activate ADAS, and the handling of third-party insurance for related accidents, facilitating verification of the current regulations.
